COA (Council of Agriculture) indicates that Council has reached a breakthrough in agreeing upon that Doritis pulcherrima is qualified applying for Plant Variety Right under the name of Phalaenopsis in Mainland China in “The 2 ^nd Working Group Conference on Plant Variety Right between Mainland China and Taiwan.” In addition, for the sake of shortening the difference in bilateral examination and test skill, in 2013, selecting Phalaenopsis, Rose, Osmanthus fragrans and Psisium guajava for conducting exchange of test skill, and hope to further adopt the test skill and verification thereof to save the human resource cost in both sides. If it works effectively, the other items will be counted in.

Doritis pulcherrima and Phalaenopsis are not easy to be differed from each other; hence the latter is gradually adopted as Plant Variety Right application among nations.

COA explained, the crossbreeding generation of Doritis pulcherrima and Phalaenopsis belongs to the Genus Doritis, which is not easy to differ from Phalaenopsis. The RHS has categorized the Doritis pulcherrima and Phalaenopsis as Phalaenopsis type in 2012, and Taiwan has also combined Doritis pulcherrima with Phalaenopsis as the Plant Variety Right application under the name of Phalaenopsis through the examination of the orchid family committee of COA in March, 2013. In order to assist Taiwan in protecting the Plant Variety Right of Doritis pulcherrima in Mainland China, the committee proposed Mainland China adopting Phalaenopsis and Doritis pulcherrima are qualified for applying Plant Variety Right under the name of Phalaenopsis in “ The 2 ^nd Working Group Conference on Plant Variety Right between Mainland China and Taiwan” on April, 2013 so that can connect with international countries. The major breakthrough is attained after negotiation, and from now on, Doritis pulcherrima is qualified for applying Plant Variety Right under the name of Phalaenopsis in Mainland China.

Reducing the gap between the two sides in variety test verification skill to accelerate variety review

COA said that since the Cross-Strait Intellectual Property Right Protection Cooperation Agreement was signed in June, 2010, the new types bred in Taiwan are qualified for applying Plant Verity Right in Mainland China, and through the annual Working Group Conference on Plant Variety Right between Mainland China and Taiwan consulting the problems in applying for Plant Verity Right in the future; even though there are obstacles in implementation, promoting examination of Plant Variety Right and verification thereof and so on need to be solved to ensure the rights of the applicants in both sides. Hereto, the both sides have selected Phalaenopsis, Rose, Osmanthus fragrans and Psisium guajava as the subjects for verification, and hope to further adopt the test skill and verification to save the human resource cost in both sides.
